The Labour Party (LP) has warned of legal action against the Independent National Electoral Commission (INEC) following the exclusion of its candidates from the upcoming August 16 by-election in the Abuja Municipal Area Council (AMAC).
In an open letter to INEC Chairman, Prof. Mahmood Yakubu, titled “Re: Exclusion of Labour Party Candidates from August 16 Bye-Elections”, the party described the move as unlawful and a misuse of authority.
The letter, signed by LP’s Bayelsa State Legal Adviser, Mr. Enu Kikanwa Timipre, criticized INEC for acting without notice or explanation, insisting the commission’s duty is to enforce the Electoral Act, not decide which parties may present candidates.
Timipre accused INEC of misinterpreting a Supreme Court ruling and overstepping its bounds by interfering in the party’s internal affairs.
“The Supreme Court did not authorize INEC to interfere in how our party operates,” he stated.
LP called for the immediate reinstatement of its candidates or a clear justification for their removal, warning that failure to comply would lead to legal action.
“If INEC refuses to reverse its decision, it will not only damage the credibility of the electoral process but leave us with no choice but to pursue justice through the courts,” Timipre added.
