Abuja Court Throws Out ₦45m Suit Against ICPC, Slams Plaintiff with Fine

A Federal High Court in Abuja has dismissed a fundamental rights suit filed by Mr. James Ereboye against the Independent Corrupt Practices and Other Related Offences Commission (ICPC), describing it as baseless and an abuse of court process.

Ereboye had asked the court to compel ICPC to pay him over ₦40 million for allegedly freezing his account without a court order and an additional ₦5 million for legal fees.

However, Justice Emeka Nwite ruled that the case had already been decided by another judge and is pending before the Court of Appeal, making the fresh filing improper. He described the action as “judicial rascality” and awarded ₦200,000 in damages each to ICPC, Sterling Bank, and Polaris Bank.

The court also affirmed ICPC’s power under Section 45(1) of its Act to freeze accounts under investigation without prior court approval.
